Terms and Conditions

These Terms & Conditions govern the booking and provision of travel services offered by Monkvana. They set out the rights and responsibilities of Monkvana and the Traveller in relation to bookings, payments, travel arrangements, changes, cancellations, safety, complaints and other matters relating to the Travel Contract.

By making a booking with Monkvana, the Traveller acknowledges and accepts these Terms & Conditions, subject to all mandatory rights and protections provided under applicable Polish and European Union law.

1. General Provisions

1.1. These Terms and Conditions govern the booking and provision of travel services and tourist events sold by Monkvana, operated through Himalayan Monks sp. z o.o., Poland.

1.2. The Traveller enters into the applicable Travel Contract directly with Monkvana.

1.3. The applicable quotation, itinerary, booking confirmation, pre-contractual information and Travel Contract form part of the contractual documentation.

1.4. Where a booking constitutes a package under applicable Polish law, the mandatory rights and obligations applicable to package travel shall apply.

1.5. Nothing in these Terms excludes or limits any mandatory statutory right of the Traveller.

2. Definitions

For these Terms:

“Monkvana”, “we”, “us” or “our” means Himalayan Monks sp. z o.o., operating the Monkvana travel brand.

“Traveller”, “you” or “your” means the person booking or participating in the travel services.

“Travel Contract” means the agreement between the Traveller and Monkvana.

“Package” means a combination of travel services that qualifies as a package under applicable law.

“Travel Service” means an individual travel service, including transportation, accommodation, guiding, activities or other travel-related services.

“Unavoidable and Extraordinary Circumstances” means circumstances meeting the applicable legal definition and which could not reasonably have been avoided or overcome.

3. Monkvana’s Role

3.1. Monkvana is the customer-facing seller and contracting party for bookings made through Monkvana.

3.2. Monkvana may arrange travel services through third-party suppliers and local service providers.

3.3. Where Monkvana is legally the organiser of a Package, Monkvana shall fulfil the responsibilities imposed on an organiser by applicable Polish and European Union law.

3.4. The legal nature of each booking and the applicable rights of the Traveller shall be determined by the Travel Contract and applicable law.

4. Scope of Services

4.1. Monkvana offers international travel experiences including trekking, adventure, cultural, nature and other journeys.

4.2. Destinations may include Nepal, Tibet, Bhutan, India and other countries.

4.3. The exact services included in a particular booking are stated in the applicable quotation, itinerary, booking confirmation or Travel Contract.

4.4. Services not expressly stated as included are excluded from the travel price.

5. Booking and Formation of Contract

5.1. A booking request does not automatically constitute acceptance of a Travel Contract.

5.2. The Travel Contract is concluded in the manner stated in the applicable booking process.

5.3. The Traveller must provide accurate and complete information required for the booking.

5.4. The Traveller should check the booking confirmation and promptly notify Monkvana of any apparent error.

5.5. Special requests are subject to availability and are not guaranteed unless expressly confirmed.

6. Pre-Contractual Information

6.1. Before the Traveller becomes bound by the Travel Contract, Monkvana shall provide the information required by applicable law.

6.2. Depending on the booking, this may include information concerning:

  • destination;
  • itinerary;
  • duration;
  • accommodation;
  • transportation;
  • activities;
  • price;
  • payment conditions;
  • passport and visa requirements;
  • insurance;
  • health and fitness requirements;
  • cancellation conditions; and
  • other important travel information.

6.3. Information required by law to form part of the contractual documentation shall be treated accordingly.

7. Prices and Payment

7.1. The applicable price is stated in the quotation, booking page, booking confirmation or Travel Contract.

7.2. Deposit and payment deadlines shall be communicated before or at the time of booking.

7.3. The Traveller must make payments by the applicable deadlines.

7.4. Unless expressly included, the Traveller is responsible for personal expenses, visas, insurance, optional activities and other services identified as excluded.

7.5. Payment-provider, bank or transaction charges may apply only where permitted by law and disclosed before the Traveller becomes bound by the contract.

8. Price Changes

8.1. Where permitted by applicable law, the price of a Package may be adjusted only in circumstances and according to procedures permitted by law and the Travel Contract.

8.2. Where applicable law gives the Traveller a right to reject a price increase or obtain another remedy, that right shall apply.

9. Changes Requested by the Traveller

9.1. Requests to change dates, accommodation, transportation, activities or other services are subject to availability.

9.2. A requested change may result in additional costs.

9.3. Monkvana shall inform the Traveller of applicable additional costs before confirming the change where reasonably possible.

9.4. A requested change is not confirmed until accepted by Monkvana.

10. Changes Made by Monkvana

10.1. Monkvana will make reasonable efforts to provide the trip according to the agreed itinerary.

10.2. Reasonable changes may sometimes be necessary because of weather, safety, transportation, governmental restrictions, environmental conditions, operational circumstances or other events.

10.3. Minor changes that do not materially affect the essential nature of the trip may be made where reasonably necessary.

10.4. Where a change constitutes a significant modification or otherwise gives the Traveller statutory rights, Monkvana shall provide the remedies required by applicable law.

11. Cancellation by the Traveller

11.1. The Traveller may terminate the Travel Contract in accordance with the Travel Contract and applicable law.

11.2. Where permitted by law, an appropriate and justifiable termination or cancellation fee may apply.

11.3. Where applicable law grants the Traveller a right to terminate without a cancellation fee because of Unavoidable and Extraordinary Circumstances, that right shall apply.

11.4. Cancellation notices should be submitted using the contact details specified in the booking documentation.

12. Cancellation by Monkvana

12.1. Monkvana may cancel a trip only where permitted by applicable law and the Travel Contract.

12.2. Where Monkvana cancels a Package, the Traveller shall receive the refunds and other remedies required by applicable law.

12.3. Cancellation information shall be communicated to affected Travellers as soon as reasonably practicable.

13. Traveller Rights Following Changes or Cancellation

13.1. Where applicable law provides rights following a significant change or cancellation, Monkvana shall inform the Traveller of those rights.

13.2. Depending on the circumstances, these may include acceptance of an alternative arrangement, a price reduction, termination or refund.

13.3. Mandatory statutory rights prevail over any conflicting provision of these Terms.

14. Travel Documents, Visas and Entry Requirements

14.1. The Traveller is responsible for possessing valid travel documents required for the journey.

14.2. These may include passports, visas, permits, health documents and other entry requirements.

14.3. Monkvana may provide general information about known requirements but cannot guarantee that a foreign authority will issue a visa, permit or entry authorisation.

14.4. The Traveller is responsible for checking requirements applicable to their nationality and circumstances.

14.5. Failure to obtain required documents may affect the Traveller’s ability to travel and any applicable cancellation rights, subject to law.

15. Insurance, Health and Fitness

15.1. Travellers are strongly advised to obtain comprehensive travel insurance appropriate to the trip.

15.2. For trekking and adventure travel, insurance should appropriately cover medical treatment, emergency evacuation, repatriation and relevant activities.

15.3. Where insurance is required by applicable law, the applicable statutory requirements shall apply.

15.4. The Traveller is responsible for assessing their ability to participate safely in the trip.

15.5. The Traveller should communicate relevant requirements or limitations that may reasonably affect safe participation.

16. Adventure Travel and Trekking

16.1. Adventure and trekking travel may involve inherent risks, including difficult terrain, altitude, weather changes, remote locations, road conditions, wildlife and limited access to medical facilities.

16.2. Travellers must follow reasonable safety instructions provided by Monkvana, guides or other authorised personnel.

16.3. Routes, activities and schedules may be adjusted where reasonably necessary for safety or local conditions.

16.4. Nothing in these Terms excludes liability that cannot legally be excluded.

17. Flights, Transportation and Accommodation

17.1. Flights are subject to airline conditions and applicable aviation regulations.

17.2. Flight schedules may change because of airline operations, weather, air-traffic restrictions, airport conditions or other circumstances.

17.3. Flights to or from mountain and remote areas may be particularly affected by weather and operational conditions.

17.4. Transportation, accommodation and other services shall be provided according to the confirmed Travel Contract.

17.5. Where necessary and permitted or required by law, reasonable alternative arrangements may be provided.

18. Traveller Conduct and Responsibilities

18.1. Travellers must behave respectfully towards other travellers, guides, employees, service providers and local communities.

18.2. Travellers must comply with applicable laws, regulations and reasonable safety instructions.

18.3. Behaviour that threatens the safety, health or wellbeing of others is prohibited.

18.4. Serious misconduct, violence, harassment, illegal activity or deliberate damage to property may result in appropriate action, subject to applicable law.

18.5. The Traveller may be responsible for loss or damage caused by their unlawful or negligent conduct, to the extent permitted by law.

19. Complaints and Problems During Travel

19.1. If a Traveller identifies a problem during the trip, they should notify Monkvana or the designated representative as soon as reasonably possible.

19.2. Prompt notification allows Monkvana an opportunity to investigate and, where reasonably possible, correct the problem.

19.3. Complaints shall be handled fairly and in accordance with applicable Polish and European Union law.

19.4. Failure to report a problem does not by itself extinguish or unlawfully restrict any statutory right.

20. Emergency Assistance

20.1. Monkvana shall provide the assistance required by applicable law to a Traveller in difficulty.

20.2. Emergency assistance may involve local emergency services, medical providers, guides, transport providers and other relevant service providers.

20.3. In remote and mountainous areas, evacuation may depend on weather, terrain, aviation availability, government permission and local infrastructure.

20.4. Where permitted by applicable law, reasonable costs arising from assistance may be charged where the Traveller intentionally or through gross negligence caused the difficulty.

21. Unavoidable and Extraordinary Circumstances

21.1. Such circumstances may include natural disasters, extreme weather, earthquakes, landslides, floods, epidemics, armed conflict, terrorism, political unrest, government restrictions, border closures, strikes, airport closures and other events that could not reasonably have been avoided or overcome.

21.2. The consequences of such circumstances shall be determined in accordance with applicable law.

21.3. Statutory rights to assistance, refunds, price reductions, termination or other remedies remain unaffected.

22. Liability, Financial Protection, Privacy and Disputes

22.1. Where Monkvana is the organiser of a Package, its liability shall be determined in accordance with applicable Polish and European Union law.

22.2. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

22.3. Where required by Polish law, Monkvana shall maintain the applicable insolvency and financial protection arrangements and provide the information required by law. Polish law requires applicable organisers and certain other tourism businesses to maintain prescribed financial protection and provide specified information to travellers.

22.4. Monkvana processes personal data in accordance with applicable data-protection legislation, including the GDPR. Further information is provided in the Privacy Policy.

22.5. The Travel Contract is subject to applicable Polish law, without depriving consumers of mandatory protections available under applicable European Union or other mandatory law.

22.6. Travellers may exercise their statutory rights before a competent court or authority and may use applicable consumer-protection or alternative dispute-resolution mechanisms.
